All tours paid online will be confirmed by Stardust Hawaii Reservation Line (via email or a phone call) at least 48 hours prior the tour date and time.

Cancelation Policy:

If the tour is cancelled by the tour operator, the full ticket price will be refunded. Cancelations prior to five days (unless it’s posted differently on a tour listing) are charged a minimum 10% of the ticket price per person administration fee. We charge 100% for No shows or cancellations within five days (unless it’s posted differently on a tour listing). Guests may be responsible for all damage to equipment if such damage is determined to be the result of reckless and irresponsible operation by the guest.

Customer Information:

Information is collected at the time of a sale in order to complete the sale and deliver the products. Customer lists are not not sold or distributed to third parties.

Credit Card Transactions:

Credit card transactions are processed by PayPal. A professional payment authorization service was chosen for added security and reliability. Only the purchase price and the credit card information provided by the customer is supplied to VeriSign. Information collected during transactions is maintained in their database for accounting and billing purposes. Information from these transactions is not released to third parties. Your credit card number is not transmitted to Segway Maui Tours.

Web Site Log Files:

Like most web sites log files are generated that show the IP Address of the visitor, date, time, and pages visited. Aggregate reports for web site visitors are generated that do not contain personally identifiable information. Advertising reports are generated that show the IP addresses of visitors who clicked on ads. This information may be sent to the advertiser to confirm the advertising fee charged. The advertiser already has this information as a result of the user clicking on the ad. No additional information about the visitor is supplied to the advertiser. The log files are eventually deleted.

TERMS AND CONDITIONS

  • We acknowledge that terms and conditions posted on travel supplier sites are available to review. Acceptance of documents and/or invoices, either physical or electronic, is an acknowledgement that you accept these terms and conditions.
  • Cancelation fees are imposed by almost all travel suppliers. These penalties are available from Stardust Hawaii and on the travel supplier website. In addition, Stardust Hawaii reserves the right, at Stardust Hawaii discretion, to impose a fee of 10% of a ticket price per guest as a cancelation fee. By accepting this invoice, you agree to these cancelation penalties and further agree that there will be no attempt on your part to reverse any credit card charges for such penalties as applied by the vendor or Stardust Hawaii. Stardust Hawaii reserve to charge a cleaning fee ($150-$400 depend on the size of a vehicle) If a vehicle requires excessive cleaning or special cleaning products, a cleaning fee will be applied to your overall tour or rental cost.
  • Chargebacks or reversal of charges. This invoice serves as acknowledgement that the charges made on your behalf for any form of travel purchased through Stardust Hawaii are legitimate charges, and you will not challenge any legitimate charges made. In the event of doing any chargeback or attempt to reverse your credit card for these legitimate charges, you will be responsible for any court costs incurred by Stardust Hawaii to recover those funds.
  • Checks returned for insufficient funds or stop payments, will result in maximum penalties as allowed by Hawaii Law and Statute. Insufficient funds checks will be subject to maximum penalties allowed, and may be subject to criminal prosecution, and any other applicable laws and statutes.
  • Litigation: In case of litigation, all litigation will occur in a Hawaii Court of Law, or be mitigated by a licensed arbitrator chosen by Stardust Hawaii.
  • Tour pricing is subject to change without notice due to currency fluctuations, tariff charges, or
    increases in operational expenses. In addition, some tours are based on a minimum number of guests participating. The tour company has the right to cancel a scheduled departure and offer an alternative date.
  • Forms of payment: Credit cards are accepted for payment provided the travel supplier accepts them. An invoice from Stardust Hawaii has the same strength as signature on file, and will be considered as such in a court of law or for any challenges to a reversal of charges on a credit card.
  • Ages of travelers: Travelers are subject to the restriction imposed by the travel provider as outlined online or in the appropriate brochure.
  • Segway of Maui shall not be responsible for any traveler being denied boarding, or access to any form of travel or accommodations including but not limited to trains, planes, hotels, public or private transportation for any reason, including but not limited to health issues or insufficient documentation.

We respect and are committed to protecting your privacy. This Privacy Policy lets you know how your personal information is processed and used. We will use your personal information only in ways that are compatible with this Privacy Policy.

  • We will NEVER sell your e-mail address or any other information about you to a third party.
  • When purchasing tickets, all information gathered is strictly confidential and shared only with our financial institution for processing!
  • We maintain a strict “No-Spam” policy, which means we do not sell, rent, or otherwise give your personal information to outside companies.

I. INTRODUCTION

Please read these terms and conditions carefully before using these websites.

For purposes of these Terms and Conditions, “you” and “your” means each person, group of individuals, entity or entities who visits these Stardust Hawaii websites (as defined below) or the Stardust Hawaii mobile app (the “Mobile App”) for any purpose.

For purposes of these Terms and Conditions, the “Website Providers” or “We” means the Stardust Hawaii final drawing including its agents, contractors, and any parties involved in creating, producing or delivering the website (including but not limited to Bubba Gump restaurant located in Lahaina, Maui, Hawaii).

In order to comply with legal requirements governing the final drawings, precise information about your location will be collected. If the Stardust Hawaii is unable to verify that you and your device are located in the USA, you will not be able participate to Stardust Hawaii final drawing. Upon successful verification of your location, you will be able to utilize these purchased Internet Tour Tickets for Stardust Hawaii final. Failure to comply with any of these requirements will result in forfeiture of all winnings.

The Stardust Hawaii reserves the right to terminate, suspend or cancel any participant for suspected fraud of any type, any attempt to purchase Internet Tour Tickets from a location that is not within the geographic boundaries of USA, the purchase or attempted purchase of Internet Tours Tickets by persons under the age of 18 years old, and for violations of any applicable rules, regulations, state or federal laws.

In the event a purchase is determined to have been placed by an individual under the age of 18, from a location outside the USA, or through any fraudulent or unlawful means, the ticket will be eliminated from final drawings or the prize will be forfeited by Segway Maui.

For purposes of these Terms and Conditions, PII means information about a natural person that is readily identifiable to that specific individual. In this case, PII includes, among other information, an individual’s name, address, telephone number and date of birth.

For purposes of these Terms and Conditions, the “Stardust Hawaii” means the Stardust Hawaii, including its agents, contractors, and any parties involved in creating, producing, or delivering these websites, including, but not limited to, Bubba Gump restaurant located in Lahaina, Maui, Hawaii and each of their respective successors and assigns.

These Terms and Conditions are a binding legal agreement between you and the Stardust Hawaii for the final drawings purpose. By participating on final drawings, you agree to be bound by these Terms and Conditions

The Stardust Hawaii may change these Terms and Conditions at any time without notice to you by posting changes on these websites. The Stardust Hawaii encourages you to review these Terms and Conditions from time to time.   • You agree to access and use these Websites only for lawful reasons. You are responsible for knowing and complying with any and all laws, statutes, rules and regulations pertaining to your use of these Websites. You are prohibited from using these Websites in any way that:

  • contains or introduces computer viruses or other disruptive, damaging or harmful files or programs; or
  • otherwise violates these Terms and Conditions or any other guidelines or policies posted on these Websites, including the Privacy Policy, which are incorporated by this reference into these Terms and Conditions.
  • The Stardust Hawaii will cooperate fully with any law enforcement officials and/or agencies if requested or required in the investigation of any users who violate these Terms and Conditions and may disclose your information to such law enforcement officials and/or agencies if required by law.

III. MAKING PURCHASES

  • A. About Eligible Participants
    • You must sign-up for an Account in order to purchase Internet Tour Tickets eligible for drawings (Not available at this time). The amounts of Internet Tour Tickets per day you are permitted to purchase is not subject to any limitations.
    • Winning in final drawing will be verified by the Stardust Hawaiiand you will be required to cooperate with airfare ticket purchase and scheduling with Stardust Hawaii. The final price is not transferable or eligible for money exchange.
  • B. Players Information
    • Any information you provide to Stardust Hawaii is subject to the Stardust Hawaii Final Drawings Privacy Policy. You are responsible to provide correct and honest information. If you fail to do so, you are responsible for any charges, costs, expenses, damages, liabilities and losses that you or the Stardust Hawaii may incur as a result. If you discover fraudulent or unauthorized purchases or funds transfers, or suspect that your purchase is being used by an unauthorized third party, you must notify the Stardust Hawaii Immediately by calling (808) 661-8284. Providing prompt notice to the Stardust Hawaii will limit your liability for such fraudulent or unauthorized transactions. You certify that any information provided to the Segway Maui in the registration form is complete and accurate.
    • The official record of all purchases and winning numbers will be maintained by the Stardust Hawaii.
  • B. Authority
    • When you provide a valid payment method to us, you confirm that you are authorized to use that payment method. When you fund a transaction, you authorize us (and our designated payment processor) to charge the full amount to the payment method you designate for the transaction. You may also authorize us to collect and store that payment method, along with other related transaction information.
  • C. Approval
    • If you pay by credit or debit card, we may obtain a pre-approval from the issuer of the card for an amount, which may be as high as the full price of your purchase. We will bill your card at the time you load funds for your Segway Maui Tour Ticket transaction, or shortly thereafter. If you cancel a transaction before completion, this pre-approval may result in those funds not otherwise being immediately available to you.
  • D. Failed Funding
    • If you fund a payment by debit card and your load transaction results in an overdraft or other fee from your bank, you are solely responsible for the resulting fee(s).
  • E. Other Provisions
    • The following terms of use apply to the Players Account and the purchase of Internet Tour Tickets:Purchases of Internet Tickets are non-refundable.You shall not sell or transfer Internet Tour to anyone.We may change the purchase price for Internet Tour Tickets (and we may also change the number of draws associated with your final drawings) at any time if necessary. We also reserve the right to stop selling Internet Tour Tickets eligible for final drawings.

V. ACTIONS WE MAY TAKE

  • A. Terminate Use
    • The Stardust Hawaii reserves the right to terminate, suspend or cancel any purchase transactions for suspected fraud of any type, any attempt to purchase Internet Tour Tickets from a location that is not within the geographic boundaries of USA, the purchase or attempted purchase of Internet Tickets by persons under the age of 18 years old, and for violations of any applicable rules, regulations, state or federal laws.
  • B. Inquiries
    • By registering for and using the Tour Ticket purchase eligible for final drawings, you acknowledge and agree that we may make any inquiries that we consider necessary, either directly or through third parties, concerning your identity.
  • D. Sharing of Information
    • We may contact your financial institution or card issuer, law enforcement, or affected third parties (including other users) and share details of your payments or transactions associated with your Internet Tour Tickets purchase, if we believe doing so may prevent financial loss or a violation of law.

VI. NOTICES AND AMENDMENTS TO THESE TERMS

  • A. Notice to You
    • By registering for the Stardust Hawaii final drawing, you agree that we may communicate with you electronically to deliver any important information regarding your purchases or your account. We may also provide notices to you by posting them on our Websites, or by sending them to an email address or street address that you previously provided to us. Website and email notices shall be considered received by you within 24 hours of the time posted or sent; notices by postal mail shall be considered received within five (5) business days of the time sent.

IN ADDITION, TO OBTAIN A PLAYERS ACCOUNT, YOU MUST PROVIDE A CURRENT VALID USA ADDRESS WHEN YOU REGISTER. You shall have no recourse and the Stardust Hawaii shall have no liability as a result of any such termination. All provisions of these Terms and Conditions relating to warranties, confidentiality obligations, proprietary rights, and limitation of liability shall remain effective despite such termination.
